Terms and conditions

1. Provider and scope

The provider of Letizgalerie is Gregor Machuletz, Fackelstraße 58, 47475 Kamp-Lintfort, Germany, e-mail: kontakt@letizgalerie.de, phone: +49 2842 1239618. The offer is aimed at consumers (Section 13 of the German Civil Code, BGB). These terms apply insofar as they were validly agreed when the contract was concluded. Existing contracts are governed by the version agreed at that time; publishing this version does not subsequently change their content.

2. Service and technical requirements

We provide a photo/video gallery for private events. Guests can upload files via a link or QR code. The buyer can view, download and delete media via a secret admin link. In addition, a live wall link is available that can display uploaded images as a slideshow during the event, for example on a projector or TV. This link only allows viewing; the buyer can exclude individual images from the display in the admin area. Guests can also voluntarily write a message with an optional name in the guestbook or record it as a voice message (up to two minutes); the buyer can switch the guestbook off and on, read, delete and save messages and decide whether they appear on the live wall. Optionally, the buyer can set up a photo challenge with tasks for the guests; photos for a task are assigned to it and can be shown on the live wall together with the task. Access ends 180 days after the event date entered, unless a different arrangement was made in the specific offer. The expiry date is shown during setup and stated in the confirmation.

Add-on “Invitation with RSVP” (only if booked separately; on Etsy as a separate complete package): Until the day before the event date entered, the guest link or QR code shows an invitation page with the details entered by the buyer in the admin area (invitation text, place, time) instead of the upload page. There, guests can accept or decline without signing up, giving their name, number of guests and an optional message, and can change their reply on the same device until the reply deadline. The buyer sees the replies in the admin area, can delete individual replies, download them as a table (CSV), set a reply deadline and the maximum number of guests per reply, and close replies. There is one shared QR code for all guests, no personal codes and no guest list with assignment; multiple or incorrect replies by individual guests therefore cannot be technically ruled out. From the event date, the same QR code leads to the upload page. Printing and sending the invitations are not included; we provide the QR code as an image file. Replies are deleted 30 days after the event date.

Add-on “QR seating chart” (only if booked separately; on Etsy as a separate package “Gallery + seating chart” or in the premium package): The buyer enters a seating list of names and table names in the admin area. A search “Where do I sit?” then appears on the guest page: guests enter at least three letters of their name and see up to five matching entries with the table name; the complete list is not shown. If the buyer wishes, the other names at the same table are also shown. We provide a print template for a poster with QR code for the entrance; printing is not included. The buyer is responsible for the accuracy and completeness of the seating list. The list is deleted 30 days after the event date.

Optional anniversary package (only when booked separately): The hosts select up to 30 photos before the normal gallery expires for a separately stored time capsule and may add a personal message. Using the same QR code, guests can submit up to 150 further photos with optional short messages from the event day through seven days afterwards. Both parts share 2 GiB of storage; only images up to 15 MiB are accepted. Before the first anniversary the hosts see only the number of guest contributions, with no content or previews. The capsule opens on the same calendar date in the following year at 00:00 German time (28 February for an event on 29 February), initially only via the secret host link. Hosts can then delete contributions and download the capsule as a ZIP. Access ends 90 days after opening, followed by deletion in the daily clean-up. The normal gallery period is not extended. An opening e-mail is queued on the day; access depends on the date, not delivery of that e-mail.

Hosts can hide their own memories and guest surprises separately, and turn either section back on through the private capsule link until access expires. Hiding does not delete saved content. When guest surprises are turned off, further guest uploads are rejected; existing contributions remain hidden from the hosts and are excluded from the ZIP download until the section is turned back on. The deletion date is unchanged.

For an existing gallery expressly marked as a test time capsule, the feature may be enabled without a separate purchase. The hosts may trigger an early test opening through their secret admin link. Guest contributions then become visible, further uploads close, and a test opening e-mail is initiated. The stated retention period until 90 days after the regular first anniversary remains in effect. Guests see a separate notice about the possible test opening before uploading.

A current browser, internet access and an e-mail address are required. Supported formats are JPEG, PNG, WebP, HEIC/HEIF (up to 15 MiB per image after resizing) and MP4, MOV and WebM (up to 150 MiB per video). Playback of individual formats depends on the device. Images may be resized and recompressed before upload; original quality and preservation of all metadata are not promised. Security updates and other legally required updates are provided to the extent required by law.

The guest link allows uploads; the admin link gives access to all media. Do not pass on the admin link. All images that have not been hidden are visible via the live wall link; only give it to people who run the display on site. Download the files you want before the gallery expires. The gallery is not a permanent archive. The technical storage budget is 25 GiB per gallery. The admin gallery shows the storage used before the limit is reached; further uploads are rejected once the limit is reached. Statutory rights in the event of defects in digital products remain unaffected.

We send automatic service reminders about backing up your data to the buyer's e-mail address halfway through the retention period and about seven days before the expiry date. The expiry date communicated remains decisive if a message cannot be delivered due to technical problems or an unreachable mailbox.

The example gallery and other example views shown on the website use AI-generated example images. They do not show a real customer gallery or real event and are illustrations of the possible gallery and live wall view; specific images or a specific number of uploaded media are not part of the service owed. The same applies to the product images in the print shop: they show the shape and use of the goods by way of example; decorations, mounts, frames, easels and wax seals shown are not included in the delivery.

3. Order, price and payment

Our sales offer is addressed exclusively to consumers whose habitual residence and billing address are in a Member State of the European Union. The billing-address country confirmed by the payment provider is decisive. We do not accept orders from Switzerland, the United Kingdom, Norway or other third countries. If Stripe only identifies a non-EU billing country after payment, no contract is concluded and the payment is refunded in full; with PayPal, the payment is not captured in this case. The event itself does not have to take place in the EU.

The paid contract can be concluded via our Etsy shop, via direct purchase if offered on the purchase page of this website, or following an inquiry on the purchase page. For Etsy, the specific listing, the total price shown there and the Etsy ordering process are decisive; payment is made using the payment methods offered in the Etsy checkout.

Direct purchase on this website: The presentation on the purchase page is not yet a binding offer. With “Buy now” you are taken to the payment page of our payment service provider Stripe. There you enter your e-mail address and payment details and can check and correct all details before submitting or cancel the purchase. By clicking the “Pay” button you submit a binding offer to buy the selected gallery and add-ons at the total price shown immediately before payment. The regular direct-purchase prices are 34.90 euros for the gallery, 44.90 euros with either the “Invitation with RSVP” add-on or the “QR seating chart” add-on, and 49.90 euros with both add-ons (together with the invitation, the seating chart costs 5 euros instead of 10 euros). Limited-time promotional prices and other discounts are shown before you place the order; the total price shown there applies. There are no shipping costs or subscriptions for the digital gallery and these add-ons. As a small business within the meaning of Section 19 of the German VAT Act (UStG), we do not charge VAT; the price shown is the final price. The contract is concluded as soon as the payment has been completed successfully and we show you the activation code on the confirmation page or send it to you by e-mail, whichever happens first. For payment methods with subsequent confirmation, the contract is concluded when the activation code is sent after receipt of payment. Payment is made using the payment methods offered on the payment page. You will receive the activation code together with these terms, the privacy policy and the cancellation policy in the version applicable at the time by e-mail to the address provided; we do not store any further retrievable contract text for you. You set up the gallery yourself using the code.

The anniversary package normally adds 19.90 euros as a one-time charge. From 21 October 2026 it costs 14.90 euros when purchased with the digital Premium package including RSVP and seating, or when both features are already active in an existing gallery or are purchased together with the capsule. Through 20 October 2026 the capsule costs 19.90 euros even with Premium; the existing introductory discount on Premium is unaffected. The total including selected add-ons is shown before payment. It can be added via the private admin link until seven days after the event, while the gallery still exists.

Payment with PayPal: Alternatively, you can pay directly with PayPal. With “Pay with PayPal” you are forwarded to PayPal. There you log in to PayPal or use the payment options offered by PayPal, see the order summary and total price and can cancel the process at any time. By clicking the button to complete the payment at PayPal (for example “Pay now”), you submit a binding offer to buy at the total price shown. The contract is concluded as soon as PayPal has confirmed the payment and we show you the activation code on the confirmation page or send it to you by e-mail, whichever happens first. We send the activation code and the legal texts to the e-mail address of your PayPal account. Otherwise, the previous paragraph applies accordingly.

The inquiry form on our purchase page is a non-binding inquiry and not yet an order subject to payment. The total price shown in the inquiry form may reflect a current promotion; if we later send a binding offer, the total price stated in that offer applies. There are no shipping costs or subscriptions for the digital gallery. In accordance with Section 19 UStG, no VAT is charged. We first confirm receipt and can then send a binding offer by e-mail with an overview of services, total price, bank details, payment reference and acceptance period.

A contract is only concluded when the full total price is credited to our account within the period stated in the binding offer.

The paragraphs above concern the digital gallery and its add-on packages. Printed goods ordered separately in the admin area are governed by section 7; shipping costs apply there in addition.

When buying via Etsy, the buyer can also unlock the gallery themselves: they enter their Etsy order number and an e-mail address on the activation page, we check via the Etsy interface whether the order has been paid, has not been cancelled or refunded and has not yet been redeemed, and then provide the one-time code immediately. After receipt of payment, the one-time access code for the e-mail address stated in the offer is provided within two working days at the latest; the gallery is set up once it has been redeemed. There are no additional charges on the activation page. The contract language is German. Confirmation of receipt, offer and access code are sent by e-mail. The legal texts sent before the contract is concluded can be saved; the offer states the applicable version. For existing contracts, the version agreed in each case remains decisive.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Gregor Machuletz, Fackelstraße 58, 47475 Kamp-Lintfort, Germany, e-mail: kontakt@letizgalerie.de, phone: +49 2842 1239618) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but this is not mandatory. A clear Etsy message to our shop is also possible. You can also declare your withdrawal using the “Withdraw from contract” button on our website (letizgalerie.de/en/withdraw, also linked at the bottom of every page); we will then confirm receipt of your withdrawal by e-mail without delay, stating its content, date and time.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Exception for printed goods

There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer's personal requirements (Section 312g (2) no. 1 of the German Civil Code, BGB). The printed signs, posters and cards you can order in the admin area are produced specifically for you with the details you choose – names, date, wording, design and, where applicable, a photo you upload – and with the personal QR code of your gallery. Your right of withdrawal is therefore excluded for these orders. We point out this exclusion separately before you place the order. For the digital gallery and the add-on packages your right of withdrawal remains unchanged.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract. This only applies insofar as the statutory requirements for compensation are met.

Immediate setup

The gallery is a digital service provided for the agreed term. Sending a QR code or admin link alone does not mean the contract has been fully performed and does not end the right of withdrawal early. When you activate the gallery we ask for your express request that the service begin immediately, but not for a waiver of your right of withdrawal. Statutory rules on the start and end of the withdrawal period remain unaffected.

If you do not want the service to begin immediately, redeem the code only after the withdrawal period has expired or contact us to set it up later. This does not create a further purchase contract.

An order number makes it easier to identify your order, but is not required for a valid withdrawal. Please do not send private admin links.

4. Voluntary flexibility promise

In addition to statutory rights, in particular the right of withdrawal, we grant the following voluntary goodwill services. They do not restrict any statutory warranty, withdrawal, termination or other consumer rights.

We move the date of a gallery that has not yet been used by guests once free of charge. The request must reach us no later than the originally planned event day. The new date must lie within the period permitted at activation.

The add-on “Invitation with RSVP” can be cancelled free of charge until the first guest reply is stored. The free cancellation covers only the price of this add-on and requires that your declaration reaches us before the first stored guest reply.

If no photo, video or guestbook message is received by 11:59 pm on the event day (German server time), we will refund the price of the gallery on request. The request must reach us within 7 days after the event day. Contributions received later do not change an entitlement that arose at that time. Only the base price shown for the gallery is refunded; prices of add-ons already used are not covered. The server timestamp recorded when the transfer is received is decisive. A technically accepted transfer that starts before the deadline is considered in the buyer's favour, even if processing ends later. The gallery is not automatically locked because of this voluntary promise. An e-mail with the order e-mail address or Etsy order number is sufficient for the request; do not send a secret admin link. We check the requirements and, if they are met, refund via the original payment method or, where this is not possible there, via a means of payment agreed with you.

The voluntary goodwill services apply to contracts concluded from version 2026-10-06.4 onwards. They do not apply if they are claimed abusively. Decisions on requests are not made exclusively by automated means.

5. Content and rights of use

Rights to photos and videos remain with the rights holders. You only allow us the use necessary for storing, processing and providing them in accordance with the contract. They are not used for advertising purposes without separate permission.

Only upload content you are entitled to share. Respect copyrights and the personal rights of people shown. Organisers inform their guests about the gallery and, if the live wall is used, also that uploaded images will be shown on site, and ensure lawful use. This does not exclude the provider's own legal obligations, in particular under data protection law and when notified of illegal content. A blanket indemnity for the actions of other guests is not required.

Illegal content can be reported via the page “Contact / report content” linked in the footer. We check specific reports and may remove illegal content or restrict the access concerned. In our decision we take into account the rights of those involved, inform them to the extent required by law and allow queries via our contact details.

6. Availability, backups and liability

Maintenance and technical faults may temporarily affect availability. Legally owed availability, rights in the event of defects and claims for damages remain unaffected. Technical database backups serve operation and are not a promised restoration of individual photos or videos. We recommend downloading important media yourself; missing backups of your own do not exclude statutory claims across the board.

Our liability is governed by the statutory provisions. This applies in particular to personal injury, data loss, claims under Art. 82 GDPR and mandatory consumer protection rights.

7. Printed goods (signs, posters and cards)

In addition to the digital gallery you can order printed goods carrying your personal QR code in the admin area of your gallery: table signs, posters, invitation cards and thank-you cards. Such an order is a separate contract of sale for goods and is concluded independently of the contract for the gallery. The presentation in the print shop is not yet a binding offer. “Order now” takes you to the payment page of our payment service provider Stripe, “Order now with PayPal” takes you to PayPal. There you enter your delivery address and payment details and can check or change all details before submitting, or cancel the purchase. By clicking the button that completes the payment you submit a binding offer to buy the goods shown at the total price shown. The contract is concluded as soon as the payment has been completed successfully and we confirm the order to you by e-mail.

The prices stated are final prices plus the separately stated shipping costs. As a small business within the meaning of Section 19 of the German VAT Act (UStG) we do not charge VAT. Shipping costs are 4.90 euros to Germany and 9.90 euros to Austria; we currently do not ship printed goods to other countries. With PayPal you choose the delivery address on PayPal's pages: if the delivery country chosen there differs from the one chosen in the print shop, the calculated shipping price does not match and we will not take the payment; in that case please order again with the correct delivery country. Delivery takes approximately 5 to 10 working days from receipt of payment (production and shipping); any different information on the order page takes precedence.

The goods are made to your specifications: they carry the names, the date, the wording and design you chose and the QR code of your gallery, and for cards optionally a photo you upload. You are responsible for the rights to any photo you upload and for the consent of the people shown in it; section 5 applies accordingly. Production and shipping are carried out on our behalf by a print partner of the Cloudprinter.com B.V. network, Netherlands; we remain your contractual partner. Delivery is made to the address you provide. For shipments to consumers, the risk of accidental loss only passes to you when the goods are handed over (Section 475 (2) BGB).

Statutory rights apply to defects in the goods (Sections 434 et seq. BGB), in particular to subsequent performance, price reduction, withdrawal and damages. Please report obvious transport damage to us promptly; this is not a condition for your rights, but it makes it easier for us to file a claim with the shipping service. Irrespective of this, we will replace a delivery that is unusable due to a printing or processing error free of charge after consultation.

Colour differences between the screen display and the print, and production-related trimming tolerances of up to 2 millimetres, are technically normal and do not constitute a defect. The QR code is generated automatically in high resolution before printing. Please check your details – in particular names, date and your own wording – in the preview before you submit the order: the goods go into production immediately afterwards and can no longer be changed.

8. Term and final provisions

The gallery is provided for the agreed fixed term. There is no automatic renewal and no subscription that continues automatically for a fee. Access to the regular gallery ends on the agreed date without notice. If the anniversary package was booked, the separate time capsule remains accessible through the private link until 90 days after the first anniversary; this service then ends without notice as well. Statutory rights of withdrawal, termination and other rights to end the contract remain unaffected.

German law applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. No exclusive place of jurisdiction is agreed with consumers.
